The Shook & Fletcher Insulation Company used asbestos in its products, including insulation, insulating cement, tapes, sealants, fiberglass, and more, until the 1970s. As a result, company employees, their families, and workers in other occupations, such as installers, pipefitters, construction workers, and laborers, were regularly exposed to asbestos.

Those exposed to asbestos from Shook & Fletcher products or manufacturing processes are now at risk of asbestos-related diseases like mesothelioma and lung cancer.

Formation of the Shook & Fletcher Asbestos Settlement Trust

Shook & Fletcher faced a significant amount of legal claims filed against them when the dangers of asbestos exposure became public.

Before filing for bankruptcy, Shook & Fletcher paid $40 million in claims. By 2002, it faced over 80,000 asbestos-related lawsuits and reported $22 million in annual earnings.

Ultimately, the company filed for bankruptcy that same year and created the Shook & Fletcher Asbestos Settlement Trust to pay out outstanding claims.

Shook & Fletcher Settlements & Payouts

Anyone who has developed an asbestos-related disease after exposure to Shook & Fletcher products or business activities has the right to file an asbestos trust fund claim.

The Shook & Fletcher trust is unusual because it funds claimants not only according to their disease type but also based on the state where their asbestos exposure occurred. Many other asbestos trust funds rely only on the type of disease.

Claimants have two choices for a trust fund settlement:

  • Expedited review (ER), which pays an established amount based on the extent of the disease
  • Individual review (IR), which pays amounts based on individual disease circumstances

Claimants who opt for expedited reviews typically receive compensation faster because these reviews are easier to process. This is ideal for asbestos victims and family members who need immediate access to funds.

Option Number 1: Expedited Review

The following is a schedule of values for Shook & Fletcher expedited review claims for a mesothelioma diagnosis in each exposure state:

DiseaseCompensation

Shook & Fletchers History With Asbestos Exposure

Until the 1970s, Shook & Fletcher produced a range of building materials, including pipe and boiler insulation, roofing products, and more, many of which contained asbestos due to the mineral’s fire-resistant properties.

These products were used widely in industrial, commercial, and shipbuilding sectors, leading to significant asbestos exposure.

In the early 2000s, after facing thousands of lawsuits related to asbestos-related illnesses, Shook & Fletcher filed for bankruptcy and established the Shook & Fletcher Asbestos Trust to compensate victims.

Any individual who was exposed to asbestos stemming from Shook & Fletchers products or operations and developed an asbestos-related disease may be eligible to collect financial compensation.

Asbestos Lawsuits Against Shook & Fletcher

By 2002, Shook & Fletcher faced 80,000 asbestos lawsuits and paid out $40 million in settlement compensation to victims of asbestos exposure.

Subsequently, Shook & Fletcher could not keep up with the claims filed against it, so it filed for Chapter 11 bankruptcy that same year. After filing for bankruptcy, the company established its asbestos trust to pay out future claims.

One notable asbestos lawsuit filed against the company includes an insulator who worked for Shook & Fletcher as well as other asbestos companies. He died after decades of asbestos exposure, and his spouse was awarded an $8.4 million verdict.

Associated Companies

Shook & Fletcher underwent one notable merger during its company history. It merged with Owens Corning Fiberglass Corporation in the 1970s to expand its product offerings and diversify into the insulation industry.

Despite this growth, mounting asbestos-related lawsuits led to significant legal and financial pressures, impacting the company’s long-term viability and culminating in its bankruptcy filing in 2002.

More than three dozen manufacturers helped Shook & Fletcher make its products. These companies, including Owens Corning Fiberglass and Dow Chemical Company, also bear some responsibility for asbestos exposure affecting workers and their families. Employees of partner companies may have also encountered asbestos products from Shook & Fletcher.
